By using this website or by placing an online ordering, you are agreeing to, and confirming that you have read and understood these Terms of service and all of the stated Policies. You are only authorized to use this website if you agree to abide by all applicable laws and to this agreement. We reserve the right to change, modify or delete portions of the Terms of service at any time without notice to you. If the winehouse has done this, the changes will be posted to the Terms of service on the website. Continuing use of the website after a revision to the Terms of service signifies your acceptance of the revised Terms of service and Policies. 

The winehouse does not and will not sell alcoholic products to any persons under the age of eighteen (18). The winehouse will ask to provide proof of age in confirmation that you are over the age of eighteen (18). By using this website, you are indicating that the person(s) receiving alcohol delivery is over the age of eighteen (18). If you are under the age of eighteen (18) or you do not agree with these terms and conditions please refrain from using this website. If you intentionally or unintentionally fabricate your age in order to obtain alcohol from the winehouse that you would otherwise not be able to obtain, you will be subject to prosecution to the fullest extent allowable by law. If upon delivery the person receiving the wine/alcohol is unable to provide a valid photo identification proving their age as defined by the Liquor Gaming Authority of Manitoba, the winehouse or its delivery agent will not be able to provide the product. The order will then be returned to the winehouse, and the original charged card will be refunded for the purchased amount. 

All wine/alcohol or other goods ordered remain the sole property of the winehouse until payment is received in full and a valid proof of age is presented. There will be no contract made between you and the winehouse. Your order is your offer to purchase from the winehouse. The winehouse has the option to decline to supply any goods or services to you for any reason. The winehouse’s total liability to you for non-delivery of charged goods is limited to the stated price and applicable taxes of the goods. When an order is pre-approved by the winehouse, your credit card will be processed. Your order will only be accepted until valid proof of age is presented. At that time, a contract will be made between you and the winehouse. 

Agreement to these Terms of service encompasses the entire agreement between you and the winehouse. Agreement to these Terms of service replaces all previous agreements, negotiations or discussions, if any, between you and the winehouse regarding the subject material contained in these Terms and Conditions. This agreement is personal to you and you may not transfer, assign, or delegate this Agreement to anyone without the express written permission of senior management or the winehouse. Any attempt made by you to delegate, assign or transfer this agreement without written permission immediately renders the agreement null and void. 

The following are the terms of a legal agreement between you and the winehouse. By accessing, browsing and/or using this website, you acknowledge that you have read, understood and agree to be bound by these terms and conditions and to comply with all applicable laws and regulations. If you do not agree with these terms and conditions, please refrain from using this website. This website is operated and controlled by the winehouse from its office in Canada. the winehouse makes no representation that materials on the website are appropriate or available for use in other locations, and access to them from areas where their contents are illegal is prohibited. Those who choose to access this website from their location do so on their own initiative and are responsible for compliance with applicable local laws;

The winehouse reserves the right to limit quantities ordered and delivered.

Price and availability information is subject to change without notice.

If a mistake occurs in any of the winehouse advertisements, it will be corrected as soon as possible and affected customers will be notified immediately. Any orders may be canceled prior to delivery and any required refunds will be processed to the applicable charged card(s).

The winehouse reserves the right to reject, correct, cancel or terminate an order for goods and services in which the price was incorrectly displayed, or where the winehouse otherwise may have displayed erroneous or inaccurate information. The winehouse reserves the right at any stage during the online ordering process, including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your order is canceled and your credit card has been charged, credit will be issued to your credit card account in the amount of the charge. Individual bank policies will determine when this amount will be credited to your account.

the winehouse is not liable for a delivery delay if it is the result of any of the following circumstances beyond our control:

War; Riot; Civil Commotion; Civil Celebration; Malicious Damage; Compliance with any current or future government law, rule, act, order or regulation; Fire, Flood, Storm, Blizzard, Tornado or other poor hazardous weather condition(s); Act(s) of God; Failure of ISP or telecommunications provider; Non-performance of duties by the winehouse’s contracted delivery service provider(s).

The winehouse reserves the right to change prices and other information on this website at any time without notice to you. The posting of prices, other policies and terms of sale are not a binding agreement and the winehouse is not obligated to sell on such terms. 

All contents of the website including text, images, photographs, graphics, logos, event descriptions and features that appear on the website, and all associated copyrights, trademarks and other intellectual property are owned, controlled or licensed by the winehouse.

You may not at any time copy, distribute, reproduce, publish or use any part of the website to create derivative, imaginative or plagiaristic work based on the winehouse website or its content. This includes republishing any part of the winehouse website or its content on another website. This also includes using any part of the winehouse website or content to create a database.

This is a comprehensive limitation of liability that applies to damages of any kind.

Risks and Warnings

Customers of the winehouse should be aware of the following risks and warnings:

Alcohol should be consumed responsibly, and in moderation.

Alcohol should not be consumed in conjunction with the operation of a motor vehicle or machinery.

People who are pregnant should not consume alcohol because of the high risk of birth defects.

A case of wine is heavy and weighs on average 15.5 kg. Please take extra care when lifting a case of wine. 

Red wine, ports and rosé may cause staining if spilled; please take extra care when handling.

Sparkling wines and Champagne can be volatile due to the carbon dioxide in the wine; please take extra care when handling and opening.

Events

the winehouse requests that you not wear personal scents to any events. Other participants may have allergies, and scents may interfere with enjoyment and appreciation of the wine. 

All participants in events at the winehouse must be eighteen (18) years of age or older.

If you are planning to drink at an event, please do not drive and arrange for alternative transportation.

Events must be paid in full at time of booking. Refunds or transfers are available up to five (5) days prior to the event. There is no refund for missed events.

the winehouse reserves the right to reschedule, cancel or postpone events. In such cases, participants in the event will be notified and fully reimbursed or issued credit.
